Terms and Conditions

These Terms and Conditions (“Terms”) apply to every offer made by Mowelli and to every distance contract concluded between Mowelli and you, the customer (“you”, “the customer”). By placing an order through our webshop, you confirm that you have read and accepted these Terms.

2. Scope and applicability

2.1 These Terms apply to all offers, orders and contracts relating to products sold to consumers through the Mowelli webshop. Sales to business or professional customers are governed by Mowelli’s separate business terms and not by these Terms; in case of doubt, the consumer Terms apply only where you are acting as a consumer.

2.2 Before a distance contract is concluded, these Terms are made available to you electronically in a way that allows you to save and reproduce them.

2.3 If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a valid provision that comes closest to its purpose.

2.4 In case of conflict between a translated version of these Terms and the Dutch version, the Dutch version prevails.

3. Products and descriptions

3.1 Our chairs, bar stools and other items are handcrafted from natural materials such as solid ash wood. Because wood is a natural material, slight variations in grain, colour and texture between individual pieces are normal and are not defects.

3.2 Product images, dimensions and colours on the website are as accurate as possible but are indicative. Minor deviations do not entitle you to a refund or replacement, unless the product materially differs from the description.

3.3 An offer is valid only while stocks last and for the period stated. Mowelli may amend or withdraw offers at any time before a contract is concluded.

4. Prices

4.1 All prices are stated in euros (€) and include VAT, unless stated otherwise. Prices exclude shipping costs, which are shown before you complete your order.

4.2 Mowelli may adjust prices at any time. The price applicable to your order is the price shown at the moment the order is confirmed.

4.3 Obvious errors or mistakes in pricing do not bind Mowelli.

5. Orders and conclusion of the contract

5.1 The contract is concluded when Mowelli confirms your order by email.

5.2 Mowelli may refuse an order or attach conditions to it (for example, in case of suspected fraud, a history of non-payment, or stock limitations). If an order is refused, you will be informed within a reasonable period.

6. Payment

6.1 The accepted payment methods are shown at checkout.

6.2 Payment is due at the time of ordering, unless another arrangement is agreed in writing.

6.3 You can request an invoice by emailing support@mowelli.com with your billing details, via  your customer account, and/or and confirmation email. 

7. Delivery and shipping

7.1 Mowelli ships to the following countries:

We do not ship to overseas territories. Shipping costs are calculated according to the delivery country and are shown before you complete your order.

7.2 For deliveries within Belgium, in-stock items are normally delivered within 1–3 working days, and the day before delivery you receive a track & trace code with the delivery time slot. Delivery times for other countries vary depending on the destination and the carrier. For items not in stock, an expected shipping date is shown on the website.

7.3 Stated delivery times are estimates and are not binding deadlines, unless expressly agreed otherwise. A delay does not entitle you to compensation, except where required by mandatory law.

7.4 Pick-up is only possible at our Nazareth Warehouse Testpoint in Belgium. Please arrange this in advance via our Testpoints page at https://www.mowelli.com/pages/testpoints.

7.5 Transport damage must be reported to Mowelli within 3 days of delivery, with photographs of the product and the packaging, by filling in our damage complaints form. This reporting period does not affect your statutory rights as a consumer.

7.6 The risk of loss or damage to the products passes to you once you (or a third party designated by you, other than the carrier) have taken physical possession of the products.

8. Retention of title

The products remain the property of Mowelli until you have paid the full purchase price, including any shipping costs and other amounts due.

9. Right of withdrawal (statutory 14-day right)

9.1 As a consumer, you have the right to withdraw from your purchase within 14 calendar days without giving any reason. This period starts on the day you (or a third party designated by you) take physical possession of the products. Where an order is delivered in several shipments, the period starts on the day the last item is received.

9.2 To exercise this right, you must inform Mowelli of your decision by a clear statement before the 14-day period expires — via our Return Portal, by email to support@mowelli.com, or using the model withdrawal form in the Annex below. Sending the notice before the deadline is sufficient.

9.3 You must return the products without undue delay and in any event within 14 days of notifying us of your withdrawal. The products must be returned complete and, where possible, in their original packaging.

9.4 Return costs: for the statutory right of withdrawal, you bear the direct cost of returning the products.

9.5 You are only liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

9.6 Refunds: Mowelli will reimburse all payments received from you, including the standard delivery costs, without undue delay and at the latest within 14 days of being informed of your withdrawal. Mowelli may withhold the refund until it has received the products back or you have supplied proof of return, whichever is earliest. Mowelli reimburses using the same payment method you used, unless agreed otherwise; this causes no extra costs for you.

9.7 Mowelli does not reimburse any shipping or return shipping costs. 

9.8 Exchanges: if you would like a different colour, size or model, you can request an exchange via our Return Portal within the applicable return window. We treat an exchange as a return of the original item plus a new order; the original item must meet the return conditions above. Requesting an exchange does not extend or restart the statutory withdrawal period.

10. “60 Days to Fall in Love” trial (voluntary commercial offer)

10.1 In addition to — and without limiting — your statutory 14-day right of withdrawal, Mowelli offers a voluntary 60-day home trial on chairs. Returns must be done through our Return Portal

10.2 Under this offer you may return eligible chairs within 60 days of delivery. If you ask Mowelli to arrange the return pick-up, the pick-up cost is shared: you pay 50% of the pick-up cost per chair and Mowelli covers the remaining 50%. Shared-cost pick-up is available in Belgium and the Netherlands. If you arrange the return yourself, you bear the full cost of returning the chairs.

10.3 To keep this offer valid, please keep the original packaging until the end of the trial period.

10.4 Cushions and tables are excluded from the 60-day trial. The trial applies to chairs only. Re-seat (pre-owned/refurbished) items and items bought on sale or at a discount are also excluded from this voluntary trial, but keep the statutory 14-day right of withdrawal under Section 9. Products other than chairs must be returned within 14 days via our Return Portal.

10.5 This is a commercial gesture by Mowelli and does not affect or reduce your statutory rights described in Sections 9 and 11.

10.6 Chairs returned under this offer must be complete and in resaleable condition. Mowelli may refuse a return under this trial, or reduce the refund to reflect any diminished value, where a chair is returned damaged or showing wear beyond what is necessary to try it at home. Returns under this voluntary trial are not accepted once the 60-day period has ended. This clause concerns the voluntary trial only and does not affect your statutory rights under Sections 9 and 11.

11. Legal conformity and commercial warranty

11.1 By law, Mowelli is responsible for any lack of conformity of the products that exists at the time of delivery and which appears within the legal period applicable to consumer sales.

11.2 In addition to the legal guarantee above, Mowelli provides a voluntary commercial warranty against manufacturing defects on new items — chairs, bar stools, lounge chairs, cushions and tables — for 2 years from delivery. New items bought on sale or at a discount carry a 1-year commercial warranty. This commercial warranty does not cover: normal wear and tear; damage from misuse, accidents or negligence; damage occurring after delivery during customer transport or assembly; failure to follow the care instructions provided with the product; exposure to excessive moisture, heat or direct sunlight; stains, burns, cuts, scratches or marks; damage caused by pets; contact with chemicals, solvents, dyes or unsuitable cleaning products; and any alteration, repair or modification made by you or a third party. Cosmetic variation in natural wood (grain, colour, knots) is not a defect. Following the care instructions is a condition of this commercial warranty.

11.3 If a product is defective, fill out our claims form with a description and photographs. Where a valid claim is accepted, Mowelli will, at its discretion and in line with your legal rights, repair, replace or refund the product.

11.4 Approved refunds are processed within 14 business days after inspection of the returned product.

12. Complaints and dispute resolution

12.1 We aim to handle complaints quickly. Please send complaints to support@mowelli.com; we will confirm receipt and respond as soon as possible.

12.2 If we cannot resolve your complaint together, you, as a consumer, may contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), an independent public body: https://consumerombudsman.be.

13. Liability

13.1 Nothing in these Terms limits Mowelli’s liability where it cannot lawfully be limited, including for death or personal injury caused by negligence, fraud, or your mandatory statutory consumer rights.

13.2 Subject to the above, Mowelli is not liable for indirect or consequential loss, and its total liability for any order is limited to the value of that order.

14. Force majeure

Mowelli is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including supply disruptions, carrier delays, fire, flood, strikes or government measures. During such circumstances, Mowelli’s obligations are suspended.

15. Privacy and personal data

Mowelli processes personal data in accordance with the GDPR and with its Privacy Policy, available at https://mowelli.com/policies/privacy-policy.

16. Intellectual property

All content on the Mowelli website — including text, photographs, designs, logos and the Mowelli name — is protected by intellectual property rights and belongs to Mowelli or its licensors. You may not reproduce or use this content without prior written permission.

17. Gift cards

17.1 Gift cards are available in the standard amounts shown on the website.

17.2 Gift cards cannot be exchanged for cash and are valid for the period stated at purchase or as required by law.

18. Governing law and jurisdiction

18.1 These Terms and all contracts are governed by Belgian law. Mandatory consumer-protection rules of your country of residence within the EU continue to apply where more favourable to you.

18.2 Disputes will be submitted to the competent courts of the judicial district of East Flanders, Ghent division (the district of Mowelli’s registered office), without prejudice to your right as a consumer to bring proceedings before the courts of your place of residence.
